This is the silencing of child abuse & court abuse. The lower court did not like the high court telling them they got it wrong. Instead of fixing it, the child tried to escape abuse. Now the mom is being held in jail.

Hence, we recommend the consideration of the following issues in relation to the development of CEDAWโs General Recommendation Gender Stereotypes (GR 41):
1. Recommend the Elimination of Discredited Theories: Emphasize that judicial systems must categorically reject the concept of parental alienation and similar unfounded concepts that pathologize women and dismiss evidence of multiple forms of gender-based violence.
2. Strengthen Judicial Accountability Measures: Advocate for oversight mechanisms to prevent gender bias in custody proceedings and ensure that women and child safety is prioritized over rigid parental rights.
3. Counter Institutional Disinformation: Highlight the need for measures to prevent the spread of misogynistic pseudo-theories and the guarantee that State Partiesโ court decisions and legislation are grounded in reliable research.
4. Promote Trauma-Informed Legal Practices: Recommend that judges, lawyers, and social workers receive specialized training on coercive control, gender-based violence, and trauma-informed legal practices to prevent the revictimization of survivors.
