Re Kimmel, it's important that Disney has left itself an out--it is a "suspension," not a cancellation or firing. What happens in the next two days--reaction within the company but also in the press, in the industry, in Washington, among consumers, and on social media--may affect how this plays out.

This is an example where simply repeating this, as if this is legal, is a problem, because it obscures ways to push back against this.

There is actually a Supreme Court case, United States v. United States District Court (a.k.a. the Keith Case, 1972) which held that the government could not conduct warrantless electronic surveillance on domestic orgs *even for nat sec purposes*. Here is what the Court said:
