Judge Karin Immergut’s ruling capped a dramatic weekend that included President Trump sending California National Guard members to Oregon and ordering others from Texas.

Judge: That's what I'll do. Prohibit federalization or deployment of any NG troops into Oregon. For all reasons in prior opinion. Deployment of federalized military is ultra vires and contrary to law, violating Title 10, section 12406. I also find it's likely that defendants violate 10th Amendment.

Oregon (Kennedy): I think it would be appropriate for the court to issue separate 2nd TRO and incorporate by reference reasoning of initial TRO. Now we'd need to broaden: apply to deploying federalized members of NG of *any* state into Oregon.

Immergut: What I'll do is not modify my original TRO but issue a new TRO that prohibits the relocation or deployment of any federalized national guard to the state of Oregon....

Immergut: I'm handling this on expedited basis, but defendants haven't provided new info.

SHE RULES FROM THE BENCH: I grant the plaintiffs motion for a second TRO based on reasons stated in previous order...

Federal attorney insists sending already-federalized troops to Portland is different because they didn't federalize new troops. Immergut isn't buying it.

Federal attorney also trying to say Oregon, Portland and California don't have standing. And that if a new TRO is issued they'll seek a stay.

It was a beautiful Sunday in Portland. Farmer’s markets, the Portland Marathon, peaceful protests, and some views of Mt. Hood. This city is vibrant, peaceful, and resilient. We do not need a federal occupation, and we sure as hell don’t want one.

Now we have a question about whether the conditions have been met for such a deployment and, depending on what they’re exactly tasked to do, potential violations of Posse Comitatus.

Oregon has filed a declaration from the Commander of the Oregon National Guard stating that California National Guard members could be deployed "as early as today" in Oregon for the same "purposes" that Oregon National Guard members would have been deployed for absent yesterday's TRO.

Judge Immergut has scheduled a telephonic hearing for 7:00pm tonight.
