Is Full Force the same as excessive force?

GOP policies generally have not benefitted farmers and rural voters. But they keep voting for them. They are not stupid, so there is a reason for their voting behavior. One side has bad policies but makes them feel seen; the other has better policies but ignores them.

This is not complicated.

It’s easy to say, “We told you so.” It’s harder to try to understand why farmers are dissatisfied with Democrats. Rural voters have been ignored for too long, & that strategy is not working. Acknowledge their concerns instead of deriding & talking down to them.

The majority—Judges Benton & Kobes—over dissent by Judge Gruender, held it was clearly established that no more than de minimis force is allowed against a suspect of a minor crime who is not actively resisting arrest or presenting a threat. Being locked in a sleeping dragon is not active resistance.

The Eight Circuit denied qualified immunity to officers who repeatedly used pressure points on an environmental protester locked in a “sleeping dragon device” and caused the protester to suffer Bell’s Palsy (facial paralysis), tinnitus, and emotional distress.

My rural TN hometown is full of soybean farmers who could be harmed, which could wreak devastation on the local economy that relies heavily on agriculture. The downwind effects on other industries could be severe.

The detectives argued that they could not be liable for coercing a confession, manufacturing evidence, or submitting a false probable cause affidavit if they had independent probable cause to arrest a suspect. The court retorted, “[M]erely stating that principle establishes its absurdity.”

The Third Circuit rejected qualified immunity for detectives who allegedly coached a false confession to prosecute an individual for murder (who was acquitted). Per the court, “It is always unconstitutional for the police to coerce confessions & manufacture evidence to prosecute a criminal suspect.”

I wrote for the KC Star (@kansascity.com) about the inability of civilians to sue federal agents for civil rights violations & the need for Congress to codify Bivens as the President escalates his campaign to deploy federalized military personnel to some of America’s large cities.

Not only did the court reject that preventing flushing did not violate clearly established law, it declined to decide whether doing so even violated the Eighth Amendment—ensuring the law remains not clearly established.

Qualified Immunity Nonsense—The Second Circuit held last week it was not clearly established that intentionally preventing prison toilets from flushing for up to three hours at a time was cruel & unusual, despite precedent that forcing prisoners to live among their waste was too degrading to permit.
