this is a very very big story because of the apparently totally fake story ICE/DHS put out about what happened.

It is also relevant, in the context of precedent, that Judge Immergut is a Trump appointee, so it’s hard for DOJ to argue she was politically motivated.

Right…on the surface. In that it doesn’t DIRECTLY affect Texas sending the Guard to Chicago, but it does create more precedent (previously, a judge ruled that Trump broke the law when he sent the California National Guard to LA) for the already-in-progress lawsuit over sending troops to Chicago.

People trying to play gotcha games with stupid laws, fundamentally do not understand the purpose of laws being stupid, and show they can't be trusted by those the laws are clearly meant to be enforced against.

The unpredictability is key.

When the law is stupid enough, badly written and ambiguous enough, you can never be sure when it's going to step on your neck.

Even if today it didn't get you, maybe tomorrow it will.

A stupid enough law acts as stochastic terrorism.

The goal of anti trans laws is similarly not to be good law, but stupid law.

Contradictory, confusing, badly written nonsense that guarantees selective *and* unpredictable enforcement.

A good example of why the law is fake, and why trying to gotcha its hypocrisy and stupidity is futile, are voting literacy tests.

The whole point was that it allowed selective enforcement, the shittiness and internal contradiction was a *feature* not a bug.

It’s not a nationwide injunction: Judge Immergut isn’t saying that Trump & Co. can’t sent the National Guard to OTHER states; she’s saying they can’t send the National Guard—regardless of origin—to the state of Oregon, which is under her jurisdiction.
