It looked like something spooked the first agent, and then he fires the first shot. I don't think it was an accidental discharge. Maybe he heard someone say that they'd found a gun, and misunderstood.
I should add that even if the photo was first posted today, that doesn't mean that it's real, or that the gun belonged to the victim, or that he was holding it when he was shot, or that the shooting was justified.
