That's not what happened here though. At all
The full GJ originally voted against Count 1 & in favor of Counts 2 & 3.
The question that arose today is whether the govt is required to present the redrafted indictment to the full GJ and have them deliberate again & take another vote. Yes it seems.
Many are confused based off a partial snip of the Judge's earlier decision. This section more fully encompasses what the Judge understood & decided.

There's no hiding it. It's a public record. (Unless it is sealed) Sure Prejudicial for the defendant if a no billed charge remains on the indictment in court. Leave the denied child molestation charge on there to turn the jurors against the defendant.

Well, obviously not. I mean mid-term elections are a year from now and Dems would first need to win the House despite gerrymanders and voter oppression. It's just looking at possibilities how we might see DOJ misconduct since this case is ending as soon the next two weeks.
