It wouldn't matter if he was DIRECTLY in front of the vehicle. Firstly because he PUT HIMSELF there, second the vehicle was starting from dead stop so there was plenty of time/space to move, 3rd the vehicle was steering to AVOID the officer. There are more factors as well.
