IMO from the ruling, the courts can determine if it’s within his scope of duties. However, any military action would be within that scope, because he is Commander-In Chief. It would then be up to Congress to remove him/her, if they believed the illegal action rose to the level of impeachment.

Trump clearly does not understand how insurance companies spread catastrophic risk, across a large segment of the population. He’s also going to force consumers to negotiate prices directly with doctors and hospitals? This isn’t capitalism, it’s stupidity.

According to SCOTUS, it applies to every officer, except the Commander In Chief. Again, the ONLY remedy for the President issuing an illegal order is impeachment, according to the Court. This presents a major problem for a democracy, against a rouge President. Only Congress can remove him/her.

That argument was made before the court with reference to the President having Seal Team 6 kill an opponent. The Supreme Court apparently did not care. They gave him total immunity, unless Congress determines otherwise.

The problem here is technically, she is correct. SCOTUS has ruled that only Congress, through the impeachment process, has the ability to determine whether an order is illegal or illegal. Therefore, the issue becomes political rather legal. If an insurrection didn’t meet the standard, what does?
