At the baseline, they were responsible for keeping these people in place, and now in some respect they havent. So it can have the premise based on dereliction of their duty

I say with no proof of their good wellbeing, we charge them with the highest possible consequence. If they want any reduction, they need to provide details/evidence to the contrary.
