Public Counsel, CHIRLA, and the Alliance for Children's Rights collaborated with Assemblymember Celeste Rodriguez to introduce the Family Preparedness Plan Act of 2025 (AB 495). This legislation enhances and expands California's existing law, providing parents with stronger and more nuanced options for their children's care in case of sudden separation.

Family Preparedness Plan Act of 2025 What would AB 495 bill do? Expands existing legal tools. AB 495 makes a commonsense update to the existing Caregiver's Authorization Affidavit. It includes several provisions to aid families in creating and implementing family preparedness plans. The bill solely applies to trusted adults such as: extended family members or close family friends who are already caring for the child.

AB495 is an urgently needed piece of legislation that allows families to easily provide for a guardian for their children in the event they are forcibly separated— as is happening to immigrant families via escalating ICE kidnappings.
