Was Map C legal to use?
No. After considerable examination, Map C was found to violate almost every requirement. And the mapmaker himself admitted under cross-examination that he consulted partisan political voting data that was on his screen for the entirety of the map-making process. 5/5

Was the Legislature given inadequate time to draw a map?
No. This case started in August 2024, but the Legislature repeatedly pushed it back, hoping for more favorable outcomes. When it finally settled, they were given 45 days, much more than the customary 14. 4/5

Is it an "activist" judge?
No. Justice Scalia wrote a unanimous SCOTUS opinion in Growe v. Emison in 1993 that in the absence of a legal electoral map, a judge must choose a map that complies with the law, because the US Constitution and Federal law require states to have electoral maps. 3/5

Did the new map come out of nowhere?
No. The new map spent hundreds of hours being examined and cross examined in court. It was the map that best followed the requirements of Prop 4. 2/5

Does Prop 4 amend the Utah Constitution or create a "super-law"?
No. The Utah Supreme Court forbids the Legislature to repeal or amend initiatives or limit our rights unless they have a strong governmental reason, but they can amend it. 1/5

The state Constitution requires the Legislature to divide our state into districts, but the Supreme court demanded that they do so in accordance with the law, and they refused to do so. Another map had to be chosen to meet the deadline. 4/4

In the absence of a legal legislature-drawn map, and with an order from our lieutenant Governor requiring a map by this week, she did the best she could.
The Legislature could have had their map chosen if the map-makers had chosen not to violate the law in creating the map. 3/4

They asked Judge Gibson to choose a map that complied with Prop 4, and it was proven in court that the Legislature violated the law in consulting voting data as they created their submission (Map C, chosen just a few weeks ago). 2/4 (not 3, sorry)

I am an infectious disease Dr and I would gladly find something else to do with my life if we were able to eliminate all infections through vaccination and public health measures.That's how strongly I feel about infection prevention & the positive impact of vaccines. I am ok with being out of a job.
