BIG UPDATE TODAY: This afternoon, the ACLU filed a new "class action habeas" lawsuit in New York challenging the Alien Enemies Act removals. They are seeking a temporary restraining order which would basically replicate the same thing they previously had with Judge Boasberg's order.

07.04.2025 18:35 — 👍 57 🔁 19 💬 0 📌 1MEMORANDUM OPINION In 2019, an immigration judge acting under the authority delegated by the United States Attorney General and pursuant to powers vested by Congress- granted Plaintiff Kilmar Armando Abrego Garcia ("Abrego Garcia") withholding of removal, thereby protecting him from return to his native country, El Salvador. ECF No. 1 9 41; EC No. 1-1. Such protection bars the United States from sending a noncitizen to a country where, more likely than not, he would face persecution that risks his "life or freedom." See Immigration and Nationality Act ("INA"), 8 U.S.C. § 1231(b)(3)(A); see also 8 C.F.R. §$ 208.16-.18 & 24 (setting forth the standard for withholding of removal and the procedures required for its termination). Six years later, without notice, legal justification, or due process, officers from U.S. Immigration and Customs Enforcement ("ICE"), a subagency of the Department of Homeland Security ("DHS"), put him on a plane bound for the Terrorism Confinement Center ("CECOT")
NEW: As the Fourth Circuit today considers whether to block her order, Judge Paula Xinis releases a strong opinion defending it, calling Kilmar Abrego Garcia's detention "wholly lawless" and her order "the narrowest, daresay only, relief warranted." storage.courtlistener.com/recap/gov.us...

Hard to read any signs but there is one in support of sovereign Canada. The whole lawn is full, a few thousand people. It’s grey and the trees are still bare. Across the street is a 5 story cream colored early 20th century office building. More interesting Victorian-ish buildings to the sides. Behind are low, tree covered hills.

It was 40° F and raining. This is a pretty impressive crowd for Vermont.
