The state department cable obtained by the Guardian, issued on Monday, instructs visa officers to apply the “permanent fraud bar” section of the Immigration and Nationality Act to trans applicants. This section triggers lifetime exclusion from the US with limited waiver possibilities. The directive from the secretary of state, Marco Rubio, said: “In cases where applicants are suspected of misrepresenting their purpose of travel or sex, you should consider whether this misrepresentation is material such that it supports an ineligibility finding.” On 5 February Donald Trump issued an executive order barring trans athletes from competing in women’s sports.
