Title IX, the law that Trump's executive order is based on, was written in 1972 and does NOT address gender identity because transgender was not even a word back then. President Biden issued an executive order in his last year to add gender identity to Title IX based on Title VIII. The Supreme Court blocked that executive order, saying that it violated the American Procedures Act, so it was never added. President Trump issued an Executive Order to block gender identity utilizing Title IX in the SAME EXACT way President Biden did. However, an executive order must be based on existing federal law, and Title IX does not address gender identity, so there is no federal law. This means the executive order is not valid. The court case on that is working its way through the courts right now, but when no federal law exists, state law prevails. (federal versus states rights in the Constitution). The Maine Human Rights Act was updated by the Maine Legislature (not Mills) to add gender identity as a protected category, so that is the law Mills must follow. That is the law Maine schools must follow. President Trump is acting like a backyard bully by throwing a temper tantrum and 'penalizing' Maine left and right on this issue because Mills will not follow what he tells her to do. Newsflash, the President of the United States doesn't dictate federal law. Congress does. Mills, is obeying her oath to enforce the Maine constitution and our laws. She has said that Maine has a long history of standing up to bullies, and in that, I agree."
