The tragedy is the books that didn't get copied, not the ones the church did copy.
If authors have the prerogative to unpublish in a way where archivalists can be compelled to destroy their copies, then people suing those authors have the ability to demand unpublishing as a condition of judgement/settlement. It would be a monumental attack on the integrity of the public record.
