Avhumaniseringen. Den fullständiga avsaknaden av kontext. Det torra, förment korrekta språket som bara kan rättfärdiga folkmordet och inte rymmer några ord för att fördöma eller ens beskriva. ”Repressalier” som om premissen om folkmordet som berättigat försvar kan godtas.

Att säga att yttrandet inte är ”juridiskt bindande” ger en felaktig bild. Domstolen yttrar sig med stor auktoritet om hur lagen, i detta fall bl.a. fjärde Genèvekonventionen, ska förstås. GK4 är ”bindande” lag till skydd för civila i krig.

Nationella domstolar har fått en allt viktigare roll när ansvar utkrävs för internationella brott. I Sverige pågår alltjämt Lundinrättegången, som inleddes 20 år efter de åtalade gärningarna. Då, runt millennieskiftet, hamnade våldet i Sudan till slut i världens blickfång. Det behöver hända igen.

En god anledning att göra juridiska bedömningar i förväg och allt eftersom läget utvecklas, proaktivt med andra ord. När domstolarna väl kommer till skott med domar kan det annars hända att domen gäller en själv.

Samma förutsättningar gäller för övrigt i Sverige. Straffansvar kan följa när det finns en välkänd risk för att det man bidrar till är ett brott, vilket typiskt sett är långt innan alla är överens om den saken i offentligheten.
