In saying it's 'not serious,' one should say why the Eastman argument is so bad. It's bad because it assumes that a child born to immigrant parents resembles a 19th-c Indian child born on tribal soil. Even if he's right about 1860s views of 'jurisdiction,' the point doesn't generalize to immigrants.
