I find para. 4 concerning. Does this extend to those non-parties which have taken measures against the Court and breached its independence, incl. sanctions and criminal cases? Can a true "dialogue" be conducted with rogue actors "with full respect for" the Statute?

On 3 December 2025, ICC #ASP24 adopted a declaration wherein States Parties reaffirmed their unwavering support for the ICC, their commitment to the principles and values of the Statute, and expressed their grave concern about threats and coercive measures, as well as their impact. All good, but

… and the rule of law. Good to see that this subject gets broader attention. Its relevance goes far beyond the ICC.

This is from one month ago: ASP Bureau update that became public earlier this week. As of 5/11, there was no estimated completion date for the UN OIOS investigation into the ICC Prosecutor's alleged misconduct.

Yes to this. Great to see Global South states speaking up and condemning in no equivocal terms the US administration's bullying tactics as an attack on the rule of law.

This is bound, I dare say, to weaken the cooperation regime of the ICC even further, unravelling enforceability and subjecting it to various excuses and exceptions states are so good at coming up with. If anything, it must be strengthened, not eroded. It's already working poorly.

On non-cooperation Uganda voices a problematic proposal to amend Art. 87(7) ICC Statute, so each state party's internal political situation and circumstances (eg national security concerns) are analysed individually. Otherwise more withdrawals from the Statute will follow. #ASP24

Slovenia aligns itself with the EU statement in support of the ICC. Any threats against the Court are an attack on the rule of law, and must be countered by the States Parties. One such measure is amending the EU Blocking Statute.

Then comes the intriguing part: the UK encourages states parties to conduct a constructive dialogue with states not party and discuss their concerns. Interesting what the common grounds snd goals are for such a dialogue, and what parties might treat as potential bargaining chips.
