The core point of the judgment is that the Dutch Supreme Court left this legally clear issue to the counterbalancing policy decisions. The reasoning was disappointing, yet I still hope that the government finds "clear risk" (and no further balancing exercise).

This is disappointing, to say the least. Legally speaking, if there is a clear risk, EU member states cannot export relevant arms, and full stop. I do not think that other international agreements are meant to be counterbalabcing the decisions arising from this risk.

Ursula von der Leyen calls for suspension of EU trade with Israel Commission president cites illegal West Bank settlement plans, Gaza and attempts to ‘undermine two-state solution’ The European Commission president, Ursula von der Leyen, has called for a suspension of trade with Israel, as she spoke of Europe’s “painful” inability to respond to the war on Gaza and ensuring humanitarian disaster. In her most extended condemnation yet of the Israeli government, von der Leyen criticised plans for illegal settlements that would split the occupied West Bank in half, as well as incitement of violence by extremist Israeli ministers, as a “clear attempt to undermine the two-state solution”. [Opening Academic Year] Putting the obligations to co-operate and prevent international crimes above geopolitical divides When the International Court of Justice stressed the essential role of states' ‘obligation to co-operate’ in its advisory opinion on climate change of 23 July 2025, the pronouncement inevitably carried a deep sense of appeal for solidarity in the seas of geopolitical and military divisions, beyond the contour of climate change. While the Court's opinion can be characterised as 'historic' both in terms of processes and substantive clarity on applicable rules, such characterisation also captures the particular time and space in which the Court was placed in the summer of 2025, where rule- and science-based governmental decisions felt urgently needed. Read here the interview by the Asser Institute with four experts about the ICJ opinion.

In its justification for the rejection, the Ministry of Foreign Affairs fails to mention of the use of the profiling algorithm and doesn’t provide an assessment of its impact on human rights. The court hereby mandates a Fundamental Rights Impacts Assessment. 3/
