Senate Democrats could have united behind Mangi and called out the GOP smear against him as religious bigotry. Instead, ~3 Dems decided to buy into that smear (and Schumer declined to fight), and now Bove has a 3d Circuit seat.

And Senate Republicans are about to confirm him to a life appointment on a federal appeals court.

I for one think it was cool and good that nothing was done in the last four years of Democratic control to rein in the Supreme Court, I'm glad the norm respecters won out and we're all living in a rich norm-filled paradise today.

Congress created a Department of Education and made clear that the President can't unilaterally shut the department down. If the Supreme Court is going to overrule two lower courts and let that happen -- and it will be effectively irreversible -- they have an obligation to tell us why.
