But, I thought, does the world really need a whole book laying this out? Isn't it obvious, and haven't other smarter people already made this case very well?

(So full disclosure: I'm about to pitch a long-languishing book manuscript to a press or two and had been toying just a bit with developing a new project arguing the above.

I disagree gently. SCOTUS is no pawn. It's generated an environment that favors one party. This very empowered Court has made concrete choices, particularly in voting cases, to tilt the table, and it has had a large hand in breaking accountability mechanisms and democratic checks on government.

As long as you avoid any pubic law or pubic economics, you're good.

But I would note that Congress called it the War Powers Resolution, intending it to apply to any use of the US armed forces in armed hostilities.

This reminds me of the tension between engaging in a war against the rebellious south while describing the rebellion itself as a crime because the south had no constitutional power to secede. I suppose if we wish to be precise, we can describe this as an illegal/unauthorized armed conflict.

That being said, I'm not sure I agree with you. One of the core principles of the Geneva Conventions is that you must distinguish between combatants and noncombatants.

At some point, someone will write a memo providing a post hoc legal justification. Part of the reason people will be willing to do this is that previous authors of memos that justified the unjustifiable faced trivial consequences. We could make a different choice this time.

@propublica.org's Nonprofit Explorer tool has details on millions of orgs (including ProPublica) with helpful info like executive compensation, revenue, and expenses.

If we get a functional Congress at some point, I hope they will pass legislation to activate important parts of the constitution previously understood to be self-activating or constrained the exec through norms. Maybe the president cannot be targeted for civil and criminal penalties, but others can.
