Fantastic piece from our friends at @natfairhouse.bsky.social and Relman & Colfax. Proving discrimination through circumstantial or indirect evidence is an approach grounded in over half a century of case law and shouldn't be considered remotely controversial.

Homes for Young Families Part 2 | Institute for Family Studies This is part 2 of our Homes for Young Families Series, with this brief focusing on family-friendly apartments.

Very interesting report from the Institute for Family Studies on multi-bedroom floorplans that pencil just as well as floorplans with fewer bedrooms AND align with household preferences. Across all income strata, we need more family-sized multifamily units.

Pathetic. HUD is supposed to serve everyoneโ€”not sling partisan mud.

A fully funded HUD could do so much to fix our housing crisis. Instead, leadership pulls stunts like this. We can do so much better.

On Sunday, President Trump posted a horrifying screed announcing plans to force all of D.C.โ€™s unhoused residents to โ€œmove out, IMMEDIATELYโ€ & send them โ€œFAR from the Capital.โ€

W/ HUD reporting a national record of 771,480 people unhoused on a single night last yearโ€”including 5,616 unhoused people in D.C., over 80% of whom were Blackโ€”vilifying & rounding up our citiesโ€™ most vulnerable is racist, cruel, irrational & dangerous.

If the goal is to solve homelessness, forced mass displacement & criminalization do the opposite: they deepen trauma, erect barriers to housing & work, worsen racial disparities, and put women, people w/ disabilities, LGBTQ+ people, veterans, & other underserved groups at greater risk.

Serious leaders must reject Trump's approach & invest in implementing real solutions at scale: build & preserve social & public housing; expand permanent supportive housing & services; & enact strong tenant protections so residents arenโ€™t pushed into homelessness in the 1st place

U.S. Supreme Court Denies Certiorari in Takings Clause Challenge to COVID Eviction Moratorium: On June 30, 2025, the U.S. Supreme Court denied a petition for certiorari in GHP Management Corp. v. City of Los Angeles over a dissent authored by Justice Thomas and joined by Justice Gorsuch. In this case, landlords challenged an eviction moratorium that the City of Los Angeles had put in place during the COVID-19 pandemic to prevent a surge in evictions and resulting homelessness, alleging that the policy took their property without just compensation in violation of the Takings Clause of the Fifth Amendment. Although the moratorium had long since expired, the landlords sought compensation for the period during which it was in place. The Ninth Circuit had rejected the landlordsโ€™ claim, relying heavily on the Supreme Courtโ€™s 1992 decision in Yee v. City of Escondido, which upheld the constitutionality of rent control and just cause eviction protections. The landlords in GHP Management Corp., advancing an argument that had succeeded in the Eighth and Federal Circuits, argued that the Supreme Courtโ€™s decision in Cedar Point Nursery v. Hassid, which emphasized the โ€œright to excludeโ€ as a hallmark of property rights, controlled rather than Yee. The Supreme Courtโ€™s denial of certiorari in GHP Management Corp. is hugely positive for the housing justice and civil rights fields as a negative decision, especially one overturning Yee, could have had implications for a far broader set of tenant protections than just eviction moratoria. Despite this victory, it will be incumbent upon us to remain vigilant, as the groups that have been advocating for an extreme vision of property rights that would undermine tenant protections are not going away.

Good news via @prrac.bsky.social: Supreme Court denies cert in the eviction moratorium case. It could have started down the road of eliminating rent control and eviction protections, but chose not to.
