Cullen also noted the admin could've just filed an appeal in an individual immigration case and likely found swift success at the 4th Circuit or SCOTUS, like it did for USDC Boasberg's Alien Enemies Act temporary restraining order, something that was rare grounds for an appeal.

At the first break, Judge Cullen seems pretty skeptical of the DOJ's position, expressing concern that a ruling their way could pave the way for similar suits against Circuit courts and even SCOTUS. DOJ contends this suit is a "once is a generation" deal. (1/2)
