In Seattle, Los Angeles, and Washington, D.C., protesters have burned American flags in recent demonstrations- reigniting one of America's most contentious free speech questions. Two-thirds of Americans believe flag burning should be illegal. But are they right? That is the subject of this week's Dispatch Debate.
Charles Fain Lehman, fellow at the Manhattan Institute and Dispatch contributing writer, argues that flag burning isn't free speech at allβ€”it's "an act of violence against the liberties that make free speech possible." Drawing on historical Supreme Court dissents and the American free speech tradition, Lehman contends that the flag represents the entire system of constitutional liberties, including free speech itself. When protesters burn it, he argues, they're not exercising free speech but attacking the very foundation that makes such speech possible- much like incitement or obscenity, which have long been excluded from First Amendment protection.
Matthew Cavedon, Director of the Cato Institute's Project on Criminal Justice and former public defender, counters that outlawing flag burning would "undermine the banner's very. meaning." He argues that once a government decides what speech is sufficiently patriotic to allow, the law becomes a weapon rather than a shelter for all citizens.
Cavedon points to the slippery slope visible in Sweden, Britain, and Thailand, where speech restrictions have expanded far beyond what Americans would tolerate. The freedom the flag represents, he argues, is more important than its stitches and thread - and protecting even offensive symbolic speech is what truly distinguishes American liberty.
