Post by Hamilton Nolan: Straightforward illegal action that in 2024 would have been blocked by the NLRB but in 2025 the NLRB is effectively shut down. Expect much more of this. Response by Laura Harshberger: I understand the frustration and anger to see layoffs the day after a unionization announcement, but to immediately connect this to the Trump NLRB feels like fear mongering and unnecessarily chilling for the thousands of workers who are still organizing their workplaces.

The NLRB has at no point in the last 20 years been a magic wand waving institution that prevents illegal layoffs. We have no idea how the current board and regional offices will handle ULPs or hand down rulings. We should not comply in advance! Organize your workspace.

Moreover, by drawing this connection we are ignoring the agency, bravery, and solidarity of the workers at SW who chose to organize a union in the face of great uncertainty. Anyone paying attention knew things were bad; Sesame Street has no distribution home. Solidarity.
