Is it illegal? Unconstitutional? Sure. But the pretext is there and fighting it post hoc after the damage is done will be moot.

Contesting the process swings both ways. Contesting the results based on whose vote legitimately counts doesn’t. Labeling individuals as enemies of the state ineligible to cast legitimate votes meets that requirement and the surveillance state now has the means to effect that outcome.
