Arguably to conflate road-legal kits with non-road-legal is similar to conflating manufactured e-bikes with converted e-bikes. Is the damage already too severe & is action urgent? I think so.

It matters less if there is distance between rider and car I think, but up close, being tailed, it feels like it could be better to have than not to me. The integration into seatstay/dropout junctions is a half decent execution to keep it wider and distinct.
