Yeah the whole thing with doujin isn’t even that it’s legally immune to prosecution but that rights holders are known to be disposed to not enforcing IP rights for this 親告罪 so there’s an understanding there (which is also why creators in torn ‘protect’ the IP rigorously socially self police certain behaviors in their fandoms — ex. distributing plushies and figures without a special one day license is a no go, putting certain stuff in official tag is a no go.. Although, if visual artists were also expected to distribute close-ish to cost the resulting scene would certainly resemble doujin events more, where about 70% of ppl don’t make a profit and are in it for love of the fandom. I don’t think it’s possible for events like this to exist in the west :/

Theres a lot we can’t individually do anything about, like those logistical factors. That’s a reason I don’t like the self imposed cultural and moral restrictions and the various double standards regarding fic and visual work. How many visual artists could keep doing AA if they only sold at cost?

“The various reasons we can’t emulate doujin culture on a logistic level” is a whole thing for me, I don’t know as much abt the printing side of things but the lack of accessible events everyone can easily commute to to distribute more niche-interest stuff (the way a lot of fics are) is also a thing

ultimately i just yearn for the western fandom-indie scene to have more breathing room and creativity and less sameness and crass pursuit of status quo.
like everybody thinks doujin culture is cool but so few ppl seem to be open to us actually learning from and emulating it

what really gets my goat is when ppl justify this as being Wrong (tm) based on a bunch of dogmatic logic that’s completely applicable to fanart too. “it‘s made out of love for the source material!” “it doesn’t belong to you!” very little in artist alley belongs to the artists IP-wise either

i know this mentality popped up because of specific litigious authors but that would be a reason to avoid it for specific fandoms. the Japanese too consider what to distribute as doujin work on a case by case, fandom by fandom basis as well. our blanket “Let’s just never do it” is such a bummer

I dream of the day the English fandom world catches up with the Japanese one in understanding that printing out and selling your fanfic is morally and legally equivalent to printing out and selling your fancomic or fanart (i.e.: cool and fine) rather than uniquely somehow more of a litigation risk
