We just filed our PI brief in this one detailing how these stops are illegal, in part, because DHS wonโ€™t accept that REAL IDs are real.

ICE rejected one womanโ€™s ID and put her in shackles because โ€œthe Biden Administration made a lot of mistakes.โ€

Randall Gamboa in Nazi Noem custody for 8 months then died when deported back to Costa Rica.

๐ŸงตThis horrific story is being reported all over Latin America, but not the US.

Randall Gamboa, a Costa Rican, was deported from the US in such a critical health condition it required an ambulance flight.

He then died upon his return to Costa Rica after being detained for 8 months by DHS.

As Aaron points out later in the thread, not being able to work does not make immigrants deportable. So this isn't even about goosing deportations. All it does is make it more difficult for people who came here to work to work and for the people who want to hire them to hire them.

As reflected on the docket, Mr. Souvannarath filed this case pro se. It's unclear how his current counsel has obtained Mr. Souvannarath's consent to representation in this proceeding post-removal.

Despite the insinuations in Respondents' Notice, counsel for Petitioner Mr. Souvannarath met with him, at Petitioner's request, for a legal consultation on October 20, 2025โ€” days before he was removed from the United States. Counsel then proceeded, at Mr. Souvannarath's request, to look into the legal issues at bar in his case and was in the process of doing so when apprised by his wife of his sudden removal on the evening of October 27, 2025. As counsel for Respondents noted, the undersigned contacted the U.S. Attorney's Office on the morning of October 28, 2025 to apprise them of this fact, including that counsel would be enrolling in this matter, that Petitioner's removal was in violation of this Court's order, and that counsel would move to enforce the Order.

DOJ insinuates in a footnote that ACLU may not even be authorized to represent Souvannarath, an accusation that ACLU knocks down in a footnote of its own

NOTICE TO THE COURT CONCERNING MEDIA REPORTS On October 23, 2025, this Court issued a Temporary Restraining Order (TRO) commanding Respondents not to remove the petitioner, Chanthila Souvannarath, from this district or the United States. Doc. 4. Because Respondents had not appeared in the proceeding, the Court ordered the Clerk of Court to serve the TRO, by U.S. Mail, on various parties identified by the Petitioner in one of his filings. See Doc. 4, p. 5. 1 It is unclear when the Clerk completed those mailings, but a note on the docket states the Courtโ€™s order was mailed to the Petitioner 2 on Friday, October 24. See Doc. 4, docket text (reprinted below).

The U.S. Attorneyโ€™s Office is continuing work to confirm the facts. Based on currently available information, Mr. Souvannarath was removed from this district before the Court issued its order, and he was removed from the United States on Friday, October 24, before the Respondents had notice of the Courtโ€™s order. Respondents are preparing a complete Response for the Courtโ€™s consideration that will directly address these issues with supporting exhibits.

1

Of note, Petitioner identified the wrong mailing address for the U.S. Attorneyโ€™s Office. As of the filing of this Notice, the U.S. Attorneyโ€™s Office has not received the Courtโ€™s TRO by mail.

2 It is unclear whether this statement reflects a typographical error in the docket entry.

RESPONSE TO ECF NOs. 12 AND 15

Newly-retained counsel for Petitioner Chanthila Souvannarath submits this Notice in response to Respondentsโ€™ ECF Nos. 12 and 15 and raises three points.

First, Petitioner disputes the timeline and events at issue as described in Respondentsโ€™ Notice. ECF No. 12. Petitionerโ€™s habeas corpus petition was docketed and filed in this Court on October 16, 2025. See ECF No. 4 at n.1. That filing established this Courtโ€™s jurisdiction over Mr. Souvannarathโ€™s habeas petition and his attendant claims, including his claim to United States citizenship. See Ex parte Endo, 323 U.S. 283, 306โ€“7 (1944) (establishing the Endo rule that transfer does not remove jurisdiction); Padilla v. Rumsfeld, 542 U.S. 426, 435 (2004) (stating that a habeas corpus petition challenging current custody generally must be filed in the district of confinement, which was the Middle District of Louisiana at the time Mr. Souvannarath filed his petition); Padilla, 542 U.S. at 441 (explaining that a district court retains jurisdiction and โ€œmay direct the writ to any respondent within its jurisdiction who has legal authority to effectuate [the petitionerโ€™s] releaseโ€ (citing Ex Parte Endo, 323 U.S. 283)); Lee v. Wetzel, 244 F.3d 370, 373โ€“75 (5th Cir. 2001) (applying the rule as โ€œjurisdiction over a habeas petition attaches at the time of
