President Trump says he's pardoning Tina Peters even though the law says he can't pardon state charges.

Colorado's AG tells me Peters isn't getting out while the claim is litigated.

President Trump has no more power to pardon Tina Peters on state charges than he has to declare flag burning illegal or to declare Sofia Vergara unattractive.

Simply saying it does not make it so.

AG Weiser says Colorado will not release Tina Peters from the state prison in Pueblo if Peters' attorneys or representatives of President Trump show up and attempt to remove her from state custody.

AG Weiser says President Trump's attempt to expand presidential pardon power to state charges is "an off the wall legal theory."

"It's total garbage," Weiser said. "Any lawyer who argues in favor of this should be embarrassed and ashamed."

"We're not going to give in," Weiser said. "Those who cave in, those who are folders, they're the ones who end up sacrificing."

As I said on air the day of her sentencing, I was surprised by the nine year sentence - but it was like watching the meter run as she lambasted the judge, showed no remorse, and essentially tried to put on a mini trial at sentencing. We'll never know, but I wonder what she woulda gotten without that
