Well, the prosecution wont be able to argue that being drunk in public shows poor judgement. Dunn was just a DOJ employee following the example set by USAO executive managent.

Wearing body cams is usually a policy decision by the agency in question. So all DOJ agents MUST wear body cams. There are also certain situations when courts can dictate Agents doing x or y must wear bodycams.

They are not wearing body cams to avoid capturing this kind of footage. If you charge someone with assault in this case you have to turn over ALL body worn cam footage that captures audio or video of the event AND leading up to and after the event. I am sure it woukd be damning for the agents.

Also federal law enforcement agents/officers get deadly force training multiple times per year AND most review the deadly force policy specific to their agency before EVERY arrest or search warrant. Everyone knows this is a bad shoot.

Shooting someone in a car is almost never justified unless the car is used as a weapon AND you cant get out of the way. If someone is slowly rolling towards you....cant shoot them. This is a bad shoot.

There are very specific criteria for the use of deadly force. This is obviously a bad shoot.

Summarized: to shoot someone you have to believe you or someone in the immediate area is at risk of death or serious bodily harm.

The threshold for a federal agent using deadly force is the belief that the Agent or office (or someone in the immediate vicinity) is at risk of serious bodily injury or death.

Dont think this scenario is anywhere near that threshold.

There is also a caveat that says Agentc can shoot someone fleeing the scene of a violent crime. Not this either.

Also, you can't shoot someone in a car unless they are using the car as a deadly weapon. You cant shoot someone in a car to prevent escape.
