Two other thoughts: (1) GWBs nominees could be filibustered, so thatโ€™s going to moderate the noms generally, and (2) blue slips. A lot of states we think of as deep Red today (Florida, Louisiana, Missouri, etc.) had a democratic senator not that long ago who would have had to sign off.

Sure, agree. To play devil's advocate, though, if he's so determined to retire and not hide it, why not just make the announcement? Plenty of others have done it before the end of the current term. Just be out with it and get a big, fond, long farewell celebration?
