This is at least the second state AG office to create one of these "Strategic Litigation" divisions. Tennessee has one (formerly headed by Whitney Hermandorfer, now of the CA6). These cases are usually handled by the state SG. Do they need backup? Is this about credentialing more culture warriors?

Sure, agree. To play devil's advocate, though, if he's so determined to retire and not hide it, why not just make the announcement? Plenty of others have done it before the end of the current term. Just be out with it and get a big, fond, long farewell celebration?
