Posting hateful speech online could lead to police raiding your home in this European country In the U.S., most of what we say online, even if it's hate filled, is protected by the First Amendment as free speech. But in Germany, prosecutors and cops police the internet.

Unlike CJEU, SCOTUS is at least supposed to try to apply the First Amendment.

This opinion gives a roadmap for any future court to accept national security or privacy as a pretext for laws and actions that are intended to limit speech (as the bill’s supporters readily admitted).

Who knows if TikTok will remain back
online or who will own it in the long run. But Friday’s Supreme Court opinion will cause enduring damage to the First Amendment.

Still amazed that SCOTUS didn’t even try to hide the censorship motivation.

I do not think that tomorrow’s likely shutdown of TikTok will affect the company’s decision to seek cert. This is a liability for TikTok regardless of the app’s future in the US.

There is another important TikTok case at SCOTUS. TikTok likely will file a cert petition in Anderson v. TikTok, a Third Circuit opinion that narrowly construed Section 230. TikTok has retained Paul Clement and received an extension to file until Feb. 20.

Breyer’s latest HLR article reminds me why I am thankful for the writing styles of Kagan and Barrett.

Someone should write a book about why this is wrong.
