I’m having a hard time understanding your definition of confrontation. I think the word you’re looking for is proximity.

He did not confront them. He was faced down and was shot point blank in the back.

You said he confronted them with a gun. He did not. He had a holstered gun hidden on his body while he was helping a woman who fell down in the snow. That’s when they pulled him off and threw him face down on the ground.

I’m saying he was alive when he was disarmed. An agent had his (licensed) gun after taking it from his waist. So he used to have a gun, but it never fired, nor was it unholstered or pointed anywhere by him.
