Curious—how old is the 4th circuit precedent on this? Awarding fees would incentivize so many lawyers who otherwise can’t afford to help immigrants litigate wrongful detention. I’m surprised, given the current bent of the 4th, that there weren’t two votes for this or an appetite at en banc.

Also, for people involved in the criminal legal system for everything from traffic offenses to murder, the law is still very much in play and not always in fair ways. The rule of law has always been an ideal we approach asymptotically. The curve is shallower today, but we cannot stop striving.
