This enables the court to avoid embracing the govβs arg that universal injunctions can never be issued. And thereβs a βhow convenientβ to this.
You know that right-wing judge who keeps issuing nationwide injunctions re: abortion? Well, heβs interpreting a different statute, the APA. Doesnβt apply.

.
1/n Oral arguments in Consumer Research didn't sound favorable for fans of "public" non-delegation. But with a Congress currently enthrall to the executive, we should want checks on Congress' ability to delegate legislative authority, even if it desires the delegation.

@ilyasomin.bsky.social calls it correctly. The US govt has paid El Salvador to imprison individuals who are merely alleged to have a committed crimes in the US. A flagrant violation of the 5th amendment.

Does arranging and paying for the imprisonment in El Salvador of persons formerly on US soil who are merely accused (but not convicted) of criminal activity within the United States encroach on these individuals' 5th and 6th amendment rights? @stevevladeck.bsky.social #legalsky

14.03.2025 23:54 β π 18 π 8 π¬ 0 π 0This was the date set in the end of year (2024) appropriations bill passed by the prior Congress and signed by President Biden. 09.02.2025 16:41 β π 1 π 0 π¬ 1 π 03/n Moreover, there are compelling arguments that this "diktat by tweet" violates both the APA (5 U.S.C. Β§β―553) and, to the extent that granted monies represent a property interest (they do), the due process clause of the 5th Amendment.
09.02.2025 16:41 β π 0 π 0 π¬ 1 π 02/n @stuartbuck.bsky.social lays out a compelling case and identifies the key statute that makes what NIH is attempting to do ultra vires (Title II, Division H, Section 224 of Public Law 118-47). The plaint text of Section 224 forbids this type of adjustment. goodscience.substack.com/p/indirect-c...
09.02.2025 16:41 β π 2 π 1 π¬ 1 π 01/n Reasonable people can differ as to what the % threshold should be for indirects. But while our nation remains committed to the rule of law, there are bright line statutory and constitutional bars to unilaterally changing that threshold via Tweet (charitably described as sub-regulatory guidance)

In the middle of Monday night after pausing critical federal funding that American families and workers rely on, President Trump fired NLRB General Counsel Jennifer Abruzzo and Board Member Gwynne Wilcox. π§΅
29.01.2025 15:45 β π 62 π 15 π¬ 6 π 2There is simply no plausible argument that the president has the constitutional authority to refuse to spend appropriated funds because he doesnβt like how the money is being spent.
