In this case, most people are not generally complaining that some censorship is occurring as part of moderation, the concerns are that some users are being censored unfairly for merely criticizing or questioning management while other users are not censored, despite violating the terms of service.

Moderation of social networks requires censorship, but it should be done judiciously and fairly. Even when it is done unfairly it is not a 1st amendment violation unless the government does it.

That is incorrect. The thing you are thinking of is 1st amendment violations in the US. Only the government can violate the 1st amendment because it only bans government censorship. But censorship itself can be done by anyone with power over others speech. Check the dictionary to verify this fact.
