Antitrust doesn't really get at it (in fact it's kind of part of the problem), but we need to start thinking about ways to specifically punish this. One point would be that ex post facto only applies to criminal laws. A future statute could still specifically target this behavior retroactively.

FWIW DOJ still has not appealed the ruling disqualifying Halligan, nor have they appealed the Third Circuit ruling disqualifying Alina Habba on similar grounds (and nor did they respond to my request for comment about whether they plan to appeal)

Not saying this was wrong. California doesn't need intervention from the federal govt to solve problems that never really existed, but a well functioning immigration courts system is needed. There must be a better way to vet genuine asylum need through legislative reform.

A little reflection may bring to mind the many electoral cycles during which GOP (and Dem) legislators catered to donation-rich business leaders in support of economic migration - i don't want to mischaracterize, but how's "open borders" as a first try at sloganeering on this?

grateful to not be seeking asylum these days. While corrupt political influence is being pressed into these courts during 2025, much has been made of Biden's seeming to welcome asylum seekers.
