e) The Supreme Court had made the legal position clear, and so the EHRC’s obligation is to help people understand the practical implications of the judgment. An updated Code of Practice should be an important, but not the only, mechanism for discharging this obligation.
f) Public consultation on the changes to the Code should be undertaken, but that consultation should be proportionate, taking account of the fact that the body of the text has already been consulted on, the changes, while material, are confined to a few areas and the range of interested stakeholders is likely to be narrower than for the overall, main consultation held between 2 October 2024 and 3 January 2025 on the Code.
g) The public consultation timeline is to allow the updated Code to be issued to Duty Bearers and stakeholders as soon as possible and practicable following the Supreme Court decision.
h) This further consultation should not delay progress unduly, given the obvious need for clear guidance in the public domain, so the consultation period might be relatively short.
i) Stakeholders should be advised of the consultation period in advance to be prepared to submit responses.
