That's part of the 1st Amendment claim itself in this case. The nature of the statement was accurately represented as fact. It wasn't by nature a statement of opinion - though opinion would be protected under the 1st Am too. But the ruling will just be that retired officers have 1st Am rights.

Sounds to me like the judge has deciphered it quite well. It's just that there's no existing precedent holding that.

The 1st Amendment ground is an easy, easy call, based entirely on the 1st Amendment itself and very extensive 1st Amendment Supreme Court rulings.
