Judge Immergut, who was nominated by President Trump, has just granted a request by Oregon and California to block the deployment of National Guard troops from Texas and California to Portland.

Judge Immergut issues a second Temporary Restraining Order prohibiting the relocation, federalization, or deployment of ANY NATIONAL GUARD FROM ANY STATE into the state of Oregon.

This is a breathtaking abuse of the law and power by the President of the United States.

America is on the brink of martial law.

Judge Immergut isn’t playing around and I suspect will slam the Trump Administration for trying to end-run her order from yesterday blocking Trump’s call-up of Oregon’s National Guard in Portland.

I’m glad Van Jones apologized for his sick joking about dead kids in Gaza.

But the problem goes deeper: he spread Netanyahu propaganda that the mass killings of civilians in Gaza—including 20K+ kids—is Iranian fake news.

In light of Judge Immergut's ruling, there's a lot of noise today coming from the President's advisers and supporters about courts not having the power to provide prospective relief against domestic uses of the military.

It was a blunt 31-page opinion issued by a judge Trump appointed to the bench in his first term in office declaring that Trump’s effort to federalize Oregon National Guard troops likely “exceeded his statutory authority” and likely violated the Tenth Amendment.

Federal agents remained at Petitioner’s bedside during admission, transfer to non-public treatment areas, and throughout his stay, keeping him handcuffed to his hospital bed. Id. ¶ 6. On or about August 27, 2025, CBP transferred custody of Petitioner to ICE. See Pet. ¶ 48. He remains detained at Harbor-UCLA Medical Center under the supervision of ICE, which has contracted with Spectrum Detention Services (“Spectrum”) to provide guards. See Santiago Decl. ¶ 8; Pet. ¶ 48. Since that date, two to four uniformed guards—either Spectrum employees or ICE agents—have been continuously stationed in Petitioner’s hospital room, monitoring him at all times, including while he sleeps, eats, uses the restroom, or receives medical care. See Santiago Decl. ¶¶ 9–10.

ICE has been paying private security for 24/7 guards to watch a guy with no record whose leg they fucked up so badly he has been in a hospital for over a month, and we wonder why people were handing Tom Homan bags of cash.
