I’m catching up on my podcast queue, and I had to pause the 4 April episode of BBC’s Americast. It’s been 20 minutes. A guest from the Heritage Foundation was saying things that had me squinting so hard my eye were about to pop. Then he said … “The Laffer Curve is real.”

I propose a compromise. One Up First cold open in which most of your adjectives are arbitrarily bleeped.

I can’t think of any related case law on this issue, but I’m sure none of us expect any to exist. I know a couple of constitutional law professors that might be able to help. I’m leaning toward 8th/14th Amendment violations, since the U.S. can’t guarantee legal treatment in foreign jurisdictions.

So ends Matt Gaetz’s sham nomination for U.S. Attorney General that was pretense for his House resignation. He’s free and clear now, since the Ethics committee will freeze his report and the Senate can’t subpoena. I can’t find anything about this story that surprises me.

The former failed by an eyelash despite intense GOP opposition in a state that went 61% for them, while the latter crumbled under the weight of ranked-choice stigma. (Jon Tester’s history of success might have contributed to the first having support from 1/6 of GOP voters.)

@tamarakeithnpr.bsky.social Just caught today’s pod. Montana had two measures, CIs 126 and 127, top-four open primaries and majority to win respectively. (Ranked choice was not mentioned.) Since they were amendments to our constitution, the mechanism for 127 would have been up to the legislature.
