I can’t think of any related case law on this issue, but I’m sure none of us expect any to exist. I know a couple of constitutional law professors that might be able to help. I’m leaning toward 8th/14th Amendment violations, since the U.S. can’t guarantee legal treatment in foreign jurisdictions.

So ends Matt Gaetz’s sham nomination for U.S. Attorney General that was pretense for his House resignation. He’s free and clear now, since the Ethics committee will freeze his report and the Senate can’t subpoena. I can’t find anything about this story that surprises me.

@tamarakeithnpr.bsky.social Just caught today’s pod. Montana had two measures, CIs 126 and 127, top-four open primaries and majority to win respectively. (Ranked choice was not mentioned.) Since they were amendments to our constitution, the mechanism for 127 would have been up to the legislature.
