Oh it’s simple. “I’m going use something you did as justification for what I was going to do anyway.”

You know, the “you were asking for it” defense. It’s a key part of the abuser playbook.

It’s engrained in the system at *every* level, not just lawyers. But IMO the real issue is Wall Street.

Corporate officers have a legal responsibility to maximize profits, and Wall Street has gotten more and more focused on the short-term because of the ease & speed of buying & selling.

And even if it’s not legal, the individuals involved in the decisionmaking rarely get punished. The corporation has to pay a minuscule fine, which is just a price of doing business.

I think the main reason to avoid unfairness and inconsistency is that they undermine the ability of the players to make interesting decisions—so they’re actually covered by inference.
