Colbert Doesn’t Give an FCC About Calling Out CBS

Stephen Colbert says he was told by CBS lawyers "in no uncertain terms" that he could not have Texas State Rep. James Talarico on his program.

"Because my network clearly doesn't want us to talk about this, let's talk about this."

this "equal time" rule Carr is exploiting is a dated relic that the Republican-eviscerated FCC would struggle to defend in court, but because Larry Ellison's CBS is so feckless and pathetically bound to the President, they can't be bothered

One final note: this rule only applies to candidates for public office. Officeholders who aren't seeking re-election this year (Mamdani, Warren, Schumer), or those who haven't yet qualified for the ballot (Shapiro's deadline is March 10) are exempt.

Now, of course, CBS could choose to fight this. They could defend the legitimate news purposes of Colbert's interviews. But CBS's owners (Paramount/Skydance) have too much they want from the FCC, and from the Trump administration generally, to pursue that fight. And so here we are. 7/

It means that if Colbert or Meyers or The View have Talarico on, they have to give equal time on-air to every single candidate who's qualified for ballot in that US Senate race in Texas. All 3 Dems and 8 Republicans. And that means no one gets on the air.

Concerns have been raised that the industry has taken the Media Bureau’s 2006 staff-level decision to mean that the interview portion of all arguably similar entertainment programs— whether late night or daytime—are exempted from the section 315 equal opportunities requirement under a bona fide news exemption. This is not the case. As noted above, these decisions are fact specific and the exemptions are limited to the program that was the subject of the request. Importantly, the FCC has not been presented with any evidence that the interview portion of any late night or daytime television talk show program on air presently would qualify for the bona fide news exemption.20 Moreover, a program that is motivated by partisan purposes, for example, would not be entitled to an exemption under longstanding FCC precedent. Any program or station that wishes to obtain formal assurance that the equal opportunities requirement does not apply (in whole or in part) is encouraged to promptly file a petition for declaratory ruling that satisfies the statutory requirements for a bona fide news exemption. In the meantime, the Media Bureau encourages all television broadcast stations to ensure that they are making all appropriate equal opportunity filings in accordance with section 73.1943 of the FCC’s rules and as required by agency precedent.21 It is important that both broadcasters and legally qualified candidates understand the FCC’s equal opportunities regulations and how they can result in broadcasters offering opposing legal qualified candidates comparable time and placement.

Last month, Carr announced plans to tighten that rule, announcing that if a non-news talk show (whether Colbert or The View) is deemed to be "motivated by partisan purposes," then it's not doing "bona fide" news interviews and wouldn't be exempt. What does that mean? 5/

The one in play here is common sense: when it's a "bona fide news interview" or newscast, the rule doesn't apply. When one candidate does something newsworthy, you're not required to interview everyone. TV stations can make choices.
