Policing Pride: R (on the application of Lindsey Smith) v The Chief Constable of Northumbria Police [2025] EWHC 1805 (Admin) - Doing Feminist Legal Work Pride and the Police

A Gender Critical campaigner managed to convince the High Court that allowing police at Pride breached their duty of neutrality. Here, we argue that the decision is problematic, not least due to the transphobic rhetoric used

The public harassment of a barrister for using the women's toilet she was directed to on the Parliamentary estate β€” which has *not* changed its policies post-FWS β€” and the subsequent apology from Parliamentary staff to her harassers, is despicable.

- LAs should communicate effectively with parents. The LA did not discharge its s42 duty via proposals that they should have realised were not feasible for the family.

The High Court made a declaration of breach of s42 and a mandatory order requiring provision to be secured within 5 weeks.

23.12.2024 14:44 β€” πŸ‘ 0    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

The High Court held that:
- s42 is a β€˜binary’ duty and rejected the local authority’s argument that there had been no β€˜material’ breach.
- LAs need to anticipate and be proactive in preventing pending breach of s42 if eg (as happened here) a placement gives notice.
