Of these disposals, 81 claims (47%) were decided at hearing, 85 appeals (50%) were withdrawn prior to the hearing taking place, and 5 appeals were conceded.

23.12.2024 14:45 β π 0 π 0 π¬ 0 π 0- LAs should communicate effectively with parents. The LA did not discharge its s42 duty via proposals that they should have realised were not feasible for the family.
The High Court made a declaration of breach of s42 and a mandatory order requiring provision to be secured within 5 weeks.
The High Court held that:
- s42 is a βbinaryβ duty and rejected the local authorityβs argument that there had been no βmaterialβ breach.
- LAs need to anticipate and be proactive in preventing pending breach of s42 if eg (as happened here) a placement gives notice.
A very useful judgment on the scope of s42 Children and Families Act 2014 (the duty to secure special educational provision in an Education, Health and Care Plan)
