To be honest I disagree that the role of ATC will feature prominently in the probable cause. This reads to me like a case where the probable cause will be "The FAA's failure to..."
Although, as you have so eloquently and repeatedly written, Congress should be in the probable cause too.

I agree. The scope and number of problems with the procedures and practices for use of the DC airspace, especially from the military side, is enormous, from what little of the docket and hearings I have managed to catch.

No, absolutely not. The NTSB investigators' credibility is extraordinarily high. They deal with politicians speculating all the time and are well insulated from pressure.
Furthermore, the parts of the docket I have read go to great lengths to protect those involved against discriminatory abuse.

I think it's time for an update on my work. I'm currently working on no less than three articles simultaneously, of which one has reached the stage of writing the final draft. That one is a shorter article about a quite recent accident and it will be out before the end of the month!
