190. SNAP WTF? A very quick explainer on why Justice Jackson issued an "administrative stay" in the SNAP case late on Friday night, and on what's likely to happen next

If you’re trying to catch up on what went down with #SNAP late last night at #SCOTUS, here’s my attempt to read the breadcrumbs on the “administrative stay” issued by Justice Jackson—and why a justice so critical of the Court’s grants of emergency relief to Trump still granted temporary relief here:

Jury can disregard testimony in whole or part if it concludes witness misrepresented the “explosion”. It could also conclude that the fear wasn’t reasonable both bc agent exaggerated and also using its common sense (who has not been in a food fight without a vest?). Govt didn’t prove each element.

Video only showed sandwich throwing, which wasn’t the only element the govt had to prove. It had to prove that agent had a “reasonable fear of immediate bodily harm.” Bc agent exaggerated incident/fear, the jury could reject his testimony as not credible or reasonable re fear of harm.

The agent also lied about the incident. The jury was entitled to weigh his credibility and reject some, all or none of his testimony. They rejected all so auto reasonable doubt. Maybe agents should not lie and the AUSA shouldn’t elicit false testimony.

Shouldn’t ignore agent & AUSA misrepresented/exaggerated incident. Jury is entitled to reject the govt’s misrepresentations (perjury) & weigh govmt evidence against it, creating reasonable doubt. We are so used to agents lying on the stand that we’re shocked when the lies bite the govt.

Compare the "pseudo-alpha males" like Trump and Kennedy doing nothing or running away to Spanberger stopping her speech and going into action to help someone who fainted behind her.
