I have finally settled on this take:

The Pacers fine is just annoying and unnecessary. So, whatever.

The Jazz fine feels pernicious because you don’t have to get too conspiratorial to arrive at the conclusion that they were punished because Silver is in bed with the gambling companies.

I'm teaching a class on the presidency next semester. And I am 100% going to utter this sentence (with proper attribution, of course) when we get to the unit on elections.
