小和田恆元判事が、勧告的意見について、法的拘束力がなくても実際に守らざるを得ない状況をどのように作るかと言う点で、国際組織の発展の重要性を強調されていたのも印象深かった(議論の総論ではないけど)

夕方は「戦争における倫理と法」シンポジウムを拝聴。「Why War?」という問いを出発点に「倫理と法」に焦点が当てられた学際的な議論でした。「人々は経験的に歴史から学び個人の倫理性をもって叡智を尽くすことができるという点で、人々の意思と主権国家の意思は乖離している」という小和田恆ICJ元判事の見地から、それらをつなぐ制度をどのように設計していくべきかと言う議論に広がっていて興味深かった。
